ORDER

Present:       Mr. Muhammad Ali Advocate for the accused/petitioner.

                   Mr. Nadeem Iqbal, learned ADPP for the State.

  

                   Shehzad, petitioner seeks post-arrest bail in above said case FIR.

  1. Allegation against the present accused/petitioner is that on 02.08.2021, the accused/petitioner raised voice to Ahmed deceased that he would tech him lesson for posting his naked video, and made 3/4 repeated fire shots, which hit on his head, neck and thumb, who succumbed to the injuries at the spot.

  3. The petitioner has instituted the instant bail application on the statutory ground whose post arrest bail was dismissed on merits by this court vide order dated 22.11.2021. Perusal of the record shows that the petitioner filed an application on 20.09.2021 to declare him as Juvenile in the court of learned Area Magistrate. In pursuance of order dated 24.09.2021 passed by Mr. Muhammad Saeed Rafiq, the then learned Addl: Sessions Judge, the learned Area Magistrate conducted the inquiry and declared the petitioner as juvenile, and again submitted the report u/s 173 Cr.P.C of the instant case, which was entrusted to this court on 27.11.2021.  The delay in the submission of the report u/s 173 Cr.P.C and conclusion of the trial was due to the pendency of the inquiry on the application of the petitioner declaring him as juvenile.   So the accused/petitioner is not held entitled to be released on post arrest bail on statutory ground who is involved in heinous offence.  In view of above, post-arrest bail petition of the petitioner Shehzad is dismissed. File be consigned to the record room after its due completion.

So the above mentioned bail was dismissed which was submitted on statutory ground, being juvenile.
